州政府软弱的刑期改革

维州政府上周宣布计画任命由法官、学者和其他专家共同建立判案准则用于不同犯罪判决。

这看似理想的方式却有潜在的现实问题。

维州今天之所以面临软弱无力的刑罚,远不足吓阻犯罪的一大原因就是许多法官、学者和所谓的专家不支持加重量刑来维护社区安全。

因此倘若只任命一群专家来制定判案准则,就不排除有纸上谈兵、过于理想的问题,也更难以确保这些判案准则有加重量刑吓阻犯罪之效。

这也是为何自由党支持直接通过法律改革来要求法院, 对严重暴力罪犯需处最低限度的加重量刑来以儆效尤。

State government’s weak sentencing changes

 

The State government last week announced it plans to appoint a council of judges, academics and other experts to set guidelines for the courts on what sentences to apply for different crimes.

 

However, Victoria’s problem with weak sentences has occurred largely because many judges, academics and other experts won’t impose or support sentences that are long enough to deter offenders and keep the community safe.

 

Therefore, simply appointing a group of these experts to set guidelines won’t ensure the guidelines are strong enough or that criminals receive longer sentences.

 

That is why the Liberal Party supports laws that will make it compulsory for the courts to impose long minimum sentences
